The recipients of Ohio’s provisional Tier I and Tier II medical cannabis production licenses have been announced by the Department of Commerce. Twelve applicants from each Tier received provisional licenses initially. Additional licenses may be issued after September 9th, if the state population and medical marijuana patients would require so. Tier I licenses permit cultivation to 25,000 sq. ft. initially, while Tier II license holders will be limited to 3,000 sq. ft. Those cultivation sites may also expand up to three times that size, depending on the cultivator’s compliance with licensure requirements, number of patients seeking to use medical marijuana, and data from the inventory tracking system regarding patient recommendations and patient usage of medical marijuana support such expansion.
Cultivators who will be seeking to expand their marijuana cultivation areas will be required to submit an expansion plan. This plan is required to include specifications for their desired expansion that demonstrate compliance with the rules of the board of building standards and the state fire marshal. The applicant must also provide documentation demonstrating a history of compliance with all the cultivation regulations under rule of Chapter 3796 of the Revised Code, as well as demonstrating to the department that their expansion proposal will remain in compliance with the ORC.
Should the department approve this proposal, the cultivator will therefore be bound to the terms in the request for expansion and will be required to pass an inspection before cultivating in the expanded area. Failure to comply with these requirements may result in revocation of the department’s approval or additional sanctions. Cultivators are permitted to submit a request for expansion once during any twelve-month period.
Licensees are responsible for providing and maintaining any insurance coverage and terms of insurance required by the department at their own expense, prior to the issuance of a certificate of operation. They are also required to maintain an escrow account in the amount of $750,000 for Tier I cultivators and $75,000 for Tier II, as well as a surety bond in the same amount both to be made payable to the department in the event of a cultivator being in violation of the ORC. The surety bond must name the cultivator as principal of the bond, upon terms approved by the department. The terms are to include the business name and registration number, corresponding exactly with the business name and registration number in the department’s records, and must be submitted before a certificate of operation is issued.
If the department determines that the cultivator remained operational without substantial interruption, maintain an incessant supply of medical marijuana, and remain in compliance with the rules of the ORC for one year, Tier I cultivators will be eligible for a $250,000 reduction from their escrow or surety bond, $25,000 for Tier II. Another reduction after the second consecutive year, and potential elimination of the bond after three consecutive years.
